日前，迷你倉中環解放軍軍營被數名揮舞港英殖民旗的年輕人衝擊，是政府意料之外？如果駐軍開槍了，又會怎樣？找不被港人尊重的老人大出來罵，讓他們跳跳忠字舞，更升級為港獨衝擊，是解決問題的方法嗎？本位主義，本來就有，上海人、北京人、香港人，都有本位主義，如何令城市的本位主義不要升級為族群對立，是管治者的責任。最重要的是，假如動武了，將激化為非理性的族群對立，任何理性的對話解決都將無濟於事。衝擊軍營的年輕人的口號是「反對興建中環軍用碼頭，要求解放軍撤出香港」。筆者先談第二句口號「解放軍撤出香港」。香港駐軍，是主權象徵，地方政府無從反對。而且駐軍軍紀嚴未曾出事，因此港人對駐軍 沒有普遍不滿，「撤軍」只是個別激進人士說說，在社會上沒有支持。反而，筆者一直根據城市規劃上的原因，認為由於香港市區土地嚴重不足，中環軍營和市區一些軍營，真的影響了城市的發展，而且一些軍營嚴重空置。以解放軍的現代化軍力調動，郊區軍營是完全可以一小時內到達全港各地，因此長遠而言，是可以搬遷到郊區的。雖然筆者相信這建議可以幫北京撫平民心，但亦理解這問題要高層決策，完全在梁振英政府能力以外。那梁政府能力之內，又是否已經盡力，或者有能力？這是第一句口號「反對興建中環軍用碼頭」反映出的問題。中環軍事碼頭原本的法定規劃用途是「休憩用地」（註1），如果維持這法定用途，解放軍除了軍事臨時佔用之外，是必須要將其開放供作市民享用的。但是，政府建議改劃為「其他用途（軍事用地）」，本來「經常許可」的休憩用途便未必能夠在此經常發生（註2）。反對者擔心，如果解放軍可以圍封土地，公眾便難以進入了。禁區內如果市民與解放軍有衝突，香港法律不適用，便無法保障市民。那麼，解放軍要圍封嗎？還是解放軍傾向於讓市民自由享用？根據發展局長在立法會的答問，駐軍承諾在軍用碼頭不作軍事用途時，將碼頭範圍開放作為海濱長廊的一部分供公眾享用（註3）。發展局長不是已經說了嗎？我看問題不在於發展局長有沒有說明，問題在於發展局長的發言不是法律的一部分，沒有法定效力；而且這位民意支持度最低的局長沒有取得市民的信任，是「民無信不立」。而局長在立法會作政策發言時， 亦沒有提依法保障港人權益，我覺得他可能是不懂，多於是早已放棄港人權利。根據《駐軍法》，軍事禁區由駐軍管理，香港沒有管轄權，這就是大多數反對軍事碼頭者反對核心問題之所在。但同時，《駐軍法》第12條當中規定，「…… 香港駐軍對軍事禁區內的自然資源、文物古�以及非軍事權益，應當依照香港特別行政區的迷你倉將軍澳律予以保護。」筆者要指出這「非軍事權益」就是出路之所在，「非軍事權益」應該包括市民可以享用海濱長廊的權益。既然《駐軍法》都已經說明駐軍「應當依照香港特別行政區的法律予以保護，換言之只要城規會在作為法律一部分的法定大綱圖內對「法定權益」明確界定，則駐軍基於《駐軍法》應該遵守，而香港人依法享用海濱長廊的「非軍事權益」便應該可以得到法定的保障。當然，這不影響，亦無法影響駐軍必要時的使用。根據筆者的了解，多數反對者並不反對駐軍需要時可以在中環上岸的，爭取的是市民可以享用海濱長廊的權益的保障。筆者曾出席城規會有關聆訊和多方了解，問題的專業技術爭議在於是否用法定圖則指定這「軍事用地加休憩用地」（即非軍用時作休憩用地用途) 的混合用途（CompositeUse），筆者聽過一個說法，是因為目前規劃署都不管日常操作管理，沒有這個功能，所以就不管了。但根據英國有關規劃法的案例指明，從一種用途改變到另一種用途，是實質的改變用途（Material Change of Use），土地利用上「軍事用地」和「休憩用地」是兩種截然不同的用途，參考了法庭案例，希望港府明白這在規劃法上是不能含糊其詞，無視法制，混亂下去的。核心的規劃問題在於政府是否同意劃定這種「軍事用地加休憩用地」的混合用途，令兩者都依城市規劃條例，合法並存，而且受到駐軍法的保障。 從反對者角度，回復休憩用途（Open Space），註明解放軍必要時使用權益， 是最好的方案。但如果維持軍事用途Other Use（Military），而在其中指明非軍用時市民的權益，亦是專業上可以接受的。更核心的問題是，一國兩制是開歷史先河的創新，將重視法治的資本主義的香港，和仍然是半人治的社會主義的中國結合起來。假如沒有一流的人才，沒有勇於創新的官員，一國兩制將難以成功。年輕人衝擊解放軍軍營，背後是本土主義的心態，這問題不隨這個案的可能解決而解。一國兩制還要一步一步，創新的走下去。註1：城規會是法定機構，政府影響其決策。根據《城市規劃條例》而劃定的法定圖則和文字《註釋》，根據以往案例和法例，亦是法律的一部分。 因此，既可以在圖則的圖紙上說明，亦可以在《註釋》上說明有關的許可用途，包括筆者倡議的混合用途。註2：根據中區（擴展部分）分局計劃大綱草圖編號S/H24/8，「休憩用地」本來為該圖則經常許可的用途，但受到圖則各相關部分的實施限制。註3：發展局長於2013年5月28日在立法會的發言。中國及香港規劃師/公共專業聯盟副主席 吳永輝倉

The trouble connecting with MNsure was particularly annoying for consumers who still aren't clear whether they have coverage.Meanwhile, the average wait time for people calling MNsure for help Thursday was 62 minutes. The call center had received more than 2,500 calls as of 5 p.m.The first website error was reported about 11 a.m. Thursday, and the application and account portion of the website went down about 20 minutes later, said John Schadl, a MNsure spokesman. It was still down after 5 p.m. Thursday"A team is working to resolve the problem, but we do not have an estimate of when it will be repaired," Schadl wrote in an email. "It is a networking problem with the state's servers."For weeks, consumers have been frustrated by the combination of website glitches and lengthy waits at the MNsure call center.Problems persisted Tuesday as a New Year's deadline approached for people trying to obtain coverage that took effect Wednesday. There was no such looming deadline Thursday, because users who sign up for a private health plan through MNsure by Jan. 15 will have coverage that starts Feb. 1.MNsure is the state-run health exchange designed to implement the federal Affordable Care Act, which mandates that almost all Americans have health insurance or pay a tax penalty. 　　【本報訊】立法議員關翠杏要求金融管理局推動銀行取消向不動戶口和低額存款戶口收費；及要求跟進銀行卡安全的問題。　　關翠杏指出，迷你倉澳門消費者委員會二○一○年的調查顯示，本澳各家銀行基本都有對不動戶口進行收費的規定，有部分銀行甚至對存款低於一定金額的存戶收取服務費，這做法對客戶、尤其是弱勢社群並不公平。　　她說，兩個月前，香港金融管理局與香港銀行公會，已聯同當地廿二間銀行簽署了《公平待客約章》，推動銀行公平對待所有客戶，至少五間當地銀行率先宣佈取消不動戶口的收費，相信其後會有更多銀行跟隨。香港銀行公會已發函所有會員銀行，鼓勵銀行檢討小額存款戶的收費方式，建議銀行不設最低存款額收費，已有銀行響應豁免弱勢社群的小額存戶收費。　　關翠杏說，澳門暫時在這方面仍未見有任何舉措。根據資料，本澳各銀行當年是跟隨香港銀行的做法，對低額存戶和不動戶收費。現時香港銀行已陸續取消相關收費，本地應跟隨，澳門金融管理局有責任推動本澳銀行履行社會責任，取消收費，讓不同經濟能力的銀行存戶能公平地獲得服務。該局負有指導、統籌及監察本澳貨幣、金融、外匯及保險活動及市場的職責，確保其正常運作，對於涉及居民切身mini storage益的銀行卡安全問題，亦有必要儘快作出跟進和推動。　　關翠杏質詢當局：　　一、就香港金融管理局與香港銀行公會推出措施，鼓勵銀行取消不動戶及低額存戶收費的做法，當局會否跟進並推動全澳各家銀行取消有關收費？　　二、因應近年本澳曾發生多宗居民因銀行卡資料被盜取後，個人存款在外地被人盜取的案件，本人去年曾就銀行卡的安全問題兩次質詢當局。當局曾表明本澳銀行將於二○一四年完成晶片借記卡的更換工作，不過據居民反映，部分於今年才更換的借記卡仍是磁帶卡，到底當局會如何跟進有關情況？怎樣確保所有銀行能在限期內更換晶片借記卡，以保障銀行卡的交易安全？　　三、為更好地防止跨境盜取存款的犯罪，香港金融管理局已於二○一三年三月一日要求發卡銀行，將所有香港發行的借記卡和信用卡的境外自動櫃員機提款功能預設為“未啟動”，並由持卡人自行申請更改設定和內容。本人曾就有關問題質詢當局，可惜未獲回覆，基於現時本澳部分銀行已率先推出上述措施，究竟當局是否會有措施推動本澳所有銀行跟從有關做法？對於借記卡消費功能設置上，金管局曾表示會對其開通，包括預設為“未啟動”等問題作出跟進，以保障本澳居民的存款安全，究竟現時進展如何？self storage

著名插畫家及漫畫家董培新，自存倉曾說自己是「一生人畫三世畫。」的確，他從1958年到1999年間作畫不少於三十萬張，倪匡、亦舒、古龍、臥龍生等這些家喻戶曉的作家，那些年�他都畫過。獨獨金庸，是近十年才畫。2005年3月，在金庸先生的首肯與鼓勵下，他開始了金庸小說的國畫創作，那份雅氣的工筆與金庸武俠世界的沉實深厚，一相遇便相得益彰。近年靈感如泉的他，令金庸筆下的不少經典場面及人物躍現於畫紙之上，更於今年創作出十八幅金庸小說情節丹青，並收錄於最新出版的《董培新畫說金庸》（增訂本II）內。從楊過與小龍女的曠世情，到紅花會的豪情義血，董培新的畫給了我們一種從丹青筆墨�去再度觀照金庸經典形象的可能性。 ■文：香港文匯報記者 賈選凝 攝：黃偉邦董培新說，其實嚴格意義上，畫金庸與他畫了幾十年的那種「插畫」不一樣-他畫金庸，不是用插圖方式，張張都是大畫，是徵求過金庸同意之後，將他的故事畫成大圖。雖然金庸小說再版時，也從中選了一些放進新版書�做配圖，但創作的背景，畢竟不是為作小說插圖，所以，他可以更自由去選擇金庸小說中精彩的部分去畫。「以前的小說插畫，通常是一個回目必須有一張圖，特別是每日見報那種，一定要跟�情節走，畫插圖的人是被動的，現在我是主動。」董培新稱他現在可以自己選擇喜歡的部分去畫，所以我們會看到這些畫�用了各種各樣不同的表達方式。「每一張，我都會用最適當的形式去表達，自由度在我身上。畫的都是自己想要表達的情節。」畫金庸是一種還願2004年尾2005年頭時，因為董培新打算在自己六十歲時辦一場個展，而廣州又是他童年時居住的地方，就覺得展覽應該在廣州辦。廣東畫院的副院長是他很好的同學，於是他去畫院看場地，一看就被嚇到了。「就覺得好大好大，因為那主要是給人搞聯展的場地，四邊足足長達130幾米，那就要擺很多畫進去才行，八九十張才撐得起來。」而且，就算有這麼多畫擺出來，這麼大的場地，如果沒有一個好的主題，也會讓展覽變得雜亂無章好像年宵市場。思度如何是好時，董培新卻想到了2003年的一件事。「2003年，我在大會堂搞了一個自己的展覽。當時剛剛SARS之後，請了很多重要嘉賓，金庸先生也來支持展覽開幕。當時我就跟他一起看畫，跟他講，我始終有些遺憾上世紀60年代時曾婉拒他的邀請去明報。我告訴他，我很中意你的小說，但從沒畫過你的插圖。本來講完這句話沒什麼印象，但看完廣州的場地之後，忽然想到，金庸小說裡有那麼多豐富那麼多值得畫的題材，我為何不去試�徵求他的意見呢？」於是，董培新先畫了一張小龍女在古墓裡睡在繩上的圖給金庸看。金庸看完跟他說，你放心畫啦。得到了作者首肯，自此他人生裡才終於開始畫金庸的人物。而在此之前，他幫《武俠世界》畫插圖時，除了金庸、梁羽生，早就畫遍了市面上所有的武俠小說作家。從2005年開始，不到十年裡，董培新至今為止一共畫了160到170張左右的金庸丹青，本本小說都畫過。畫的情節場面，大都是通過他自己反覆看小說，選擇的自己喜歡、覺得值得畫的內容。在董培新看來，金庸小說除了有很多驚險的鬥爭，以及對人性與社會的描寫，更寫盡了人世種種。譬如他畫「不識張郎是張郎」，殷離最後見到張無忌，覺得現在這個張無忌，已經再也不是的當初那個。董培新說，有經歷的人都會明白這種感覺，所以金庸小說中其實處處都是這種閱盡人世沉浮的哲理。有時，他也會特別選擇去畫一些小說中很重要的轉捩點，譬如黃蓉夜晚給小龍女梳頭，幾句話裡道出楊過是否真可以在古墓與愛人廝守一世的疑問，這直接導致了小龍女遠走，並引發後面更淒涼的故事。對董培新來說，他每張畫裡最想捕捉到的，其實是一種金庸小說的神韻。他說自己很幸運。「畫了這麼多年，從開始到現在，從來沒人給我指示，過去新報的老闆沒給過，現在畫金庸先生，他也從來沒給我意見。他喜歡，但又不給意見，所以給了我自由的空間，對創作人來說，這是好事，因為不需要有任何顧忌。所以我也想說，多謝他放心。」但董培新明白，金庸先生是喜歡自己的畫的。2003年那場個展時，他同金庸一路看畫，一邊說自己覺得金庸是一位很尊重、喜歡畫家的人。當時金庸回答他說：「我喜歡好的畫家。」金庸本身收藏了兩張董培新的畫，一張是小龍女和楊過在古墓外練「玉女心經」，另一張是任我行被困在水底。董培新說：「其中一張是我在廣州剛開始辦展覽時收藏的，另一張是前幾迷你倉出租。我要送給他，他說不行，堅持要給我錢。」畫金庸，於董培新意味�甚麼呢？他說，是一種還願。電影感是一種畫面裡的真實很多人會覺得董培新的畫面有電影感。對此，他的看法是：「當初我在新報發展，老闆整天要問你會怎麼做，這樣就訓練到自己經常要想，怎麼和老闆講出那個場景感。後來公司1961年開始拍電影，在當時粵語片�闖出一條路。電影製作又要做很多東西，除了要參與美術方面，也要參與劇本故事研究，要做造型、佈景、廣告、海報、宣傳單張，是很大的訓練，所以有些朋友說，看這些畫好像有電影感。其實那不一定是電影感，而是將一個畫面畫成一個真實的、濃縮的場面。」他更戲稱新近上畫的《浪魂47》從美學上大概是借鑒了他畫紅花會豪傑那種一字排開的騎馬場面，所以該去拿版權費。而如今畫金庸和當年畫其他人的最大分別，在董培新自己看來，在於早期插圖其實是畫得很倉促的，因為出版時間很短促，所有事都趕得很急，沒辦法很細緻地去做。「給報紙畫，從看原稿，之後做版，時間好迫，要在很短時間盡量做好，沒法像現在這樣去深思結構。所以早期的作品一定不成熟。其實那時有某一個階段可能某些畫得比較用心，就是邵氏公司的《南國電影》」-當時那些插畫，著名漫畫家蔡志忠還剪存了下來。從不成熟到成熟，任何一位名家，都同樣需要過程。董培新2007年在台北舉辦展覽時，和蔡志忠一起做了個訪問，他說自己當年有些畫，畫得不太成熟。但蔡志忠立刻反對，蔡志忠認為每個人都有個不成熟的階段，但在那個階段�，董培新已經做得很好了。至於未來以後，董培新當然還會繼續畫。金庸故事寫了這麼多，他認為值得畫的地方也太多，更可以一邊重讀一邊決定。問董培新最喜歡金庸筆下拿個人物，他說：「單從小說角度講，最喜歡韋小寶，因為他不是個俠士，而是普通人，他又很多詭計歪念，但最後邪念都被正念壓下去-其實這就像一個人，人就是這樣嘛，不可能沒有想過其他，不可能一條直線就是我要做好人好事，但通常理智可以壓抑腦海裡的歪理。韋小寶身上有的，就是正常人都會有的那份掙扎，而非很多俠士的一團正氣。韋小寶像一個真真正正的人。另一方面，金庸先生四十幾年前寫《鹿鼎記》，如今再看，那其中的官場和今天沒分別，所以有很投入的社會感。實際上看似嬉笑怒�，但又很真實很真實，而且幾十年前就已被寫出來。韋小寶這角色在一般人眼裡並不討好，大部分人喜歡郭靖、令狐沖、楊過。當然我也很喜歡令狐沖那無可無不可的不羈，很引人入勝。」畫過這麼多位作家，他們在你眼中分別是怎樣的？董培新：古龍我喜歡，亦舒我喜歡。古龍太浪漫了，超浪漫主義。金庸的描述比古龍複雜得多，金庸是寫社會，古龍是寫感覺，所以古龍寫長篇也都等於是在寫短篇小說，他的小說，要簡單過金庸，但我也很喜歡小魚兒、蕭十一郎。倪匡則很特別，他天馬行空，想像力豐富到不得了，他也有寫武俠小說，他可能不會像金庸那樣，賦予每個人物以內在性格，他更注重故事的奇幻變化。而金庸是用人性角度去寫，所以最複雜。金庸對每一個人幾乎都有獨特描述，就算短短三兩個字，但所有人都有分別。亦舒也是寫感覺。當時的文藝小說因為是給女孩子看的，所以最重要是要表達美，這是賣點，所以那類型的插圖也強調美。如今小說插圖變得越來越少，怎麼看待時代這種轉變？　董培新：「時代在改變，寫小說的刊登機會都少了。因為讀者興趣越來越多時間花在手機上，大家喜歡讀短訊，覺得看長文字很辛苦，我會覺得對出版方面挺悲觀的。但不單香港這樣，全世界都是，對插圖需求都會更少。另外一點是，一個畫家的成長，一定要有時間去磨練，現在主要是磨練的機會都少了，寫文字出版方面的機會也少了。這一點又沒方法改變。」董培新其人一九四二年出生於廣西梧州，在廣州長大。十五歲移居香港，同年隨嶺南派高奇峰弟子蔡大可當學徒，十六歲開始以畫插圖為職業，十九歲任香港仙鶴港聯電影公司美術主任，是香港早期的電影美術指導，二十世紀七十年代開始創作漫畫，作品有《波士周時威》、《鞋底秋與爛命倫》、《豪放女》等等，高峰期擁有讀者達百萬，是當時香港知名的漫畫家及插畫家。一九八九年移居加拿大溫哥華，一九九一年拜嶺南派楊善深為師，研習中國畫。二零一零年九月、二零一三年十二月分別於杭州西湖博覽館、香港中央圖書館舉辦「董培新畫說金庸」畫展。《董培新畫說金庸》（增訂本II）畫展時間：即日起至1月5日地點：商務印書館尖沙咀圖書中心迷你倉
